9:30 a.m. - 10:20 a.m. Renewable Energy Tax Credits — Industry Update, and Washington Report
10:30 a.m. - 11:20 a.m. Solar Transactions – State of the Market
The final version of the energy legislation did not include extensions of the tax credits for renewable energy production or investment. Panelists at this session will explore current legislation and its effect on the solar market. Also discussed will be the types of solar installations that are getting done, the logistical hurdles to these installations, solar system design, and the development and installation in government, commercial and residential projects.
11:30 a.m. - 12:20 p.m. Solar Transactions – Current Structures – Financing Issues – Deal Negotiation
There is talk that diminishing rebate subsidies in California and elsewhere are pressuring the feasibility of the Power Purchase Agreement (PPA) model. This session will take a look at how the PPA model is holding up, whether lease structures are starting to take hold and what the effects of Revenue Procedure 2007-65 will be. Panelists will also look at how solar transactions are getting done in today’s market, focus on the financial structures being used by investors, address in detail how solar transactions are structured and how key tax issues and deal terms are being addressed and negotiated. Finally, the panel will explore ways the investor exits the deal, including a discussion on the use of “puts,” “calls” and “flips.”

2:00 p.m. - 2:50 p.m. Wind Transactions – Current Structures – Financing Issues – Deal Negotiation
From wind farms to offshore turbines, learn how wind transactions are getting done today. Explore with panel experts which projects are being financed, how the deals are structured, and how key tax issues and deal terms are addressed and negotiated. Join this far-ranging discussion on siting difficulties, securing turbines, completing a wind resource study, navigating the permitting process and environmental and transmission issues, as well as the effects of Revenue Procedure 2007-65.
3:00 p.m. - 3:50 p.m. Rebates, Other Subsidies, and State Tax Credits Combined
Ever-burgeoning energy industries are arising in individual states. They come in all shapes and sizes. This panel discussion will focus on which states are doing what. The programs range from property tax incentives and production tax incentives to grant programs. Rebate programs that are offered at the state, local and utility level to promote the installation of renewable energy equipment and sales tax incentives for those who invest in energy efficiency will also be reviewed.
4:00 p.m. - 4:50 p.m. Renewable Energy Tax Equity Panel
You can’t miss this session if you want to learn about what is driving investment in today’s renewable energy transactions. Panelists will address the importance of investors’ internal rate of return versus their financial statement (book) equity return, and in light of today’s shaky financial markets look at investor requirements in terms of pricing and guarantees. Get a first-hand look at the types of deal structures that are gaining the most traction in today’s marketplace and hear from active investors about the key issues on their minds.

9:00 a.m. - 9:50 a.m. Energy Credits and the NMTC
New markets tax credits (NMTCs) allocatees can assist in the financing of renewable energy projects (e.g. wind, solar, biomass) using NMTCs. Renewable energy projects are also generally eligible to generate Section 45 production tax credits or Section 48 investment tax credits. Attend this panel to learn more about the issues associated with combining NMTCS with renewable energy tax credits.
10:00 a.m. - 10:50 a.m. Residential Solar Programs - Gaining Traction
The city of Berkeley and the city of San Francisco are at the forefront of creating programs that will make it easier and more feasible than ever to get residential solar installations financed. Leasing structures are also being developed as a way to create more viable financially residential installations for consumers. Hear the city representatives and others on this panel discuss their respective programs and what is being done to get them off the ground.

Come hear about the lending programs and solutions available to developers of today’s renewable energy transactions. Our panel of experts will give a broad market overview of the debt programs available for wind and solar transactions. The panel will also discuss specific lender underwriting guidelines, deal terms and other criteria used when financing a renewable energy transaction.

Renewable energy! The buzz is growing and the experts on our panel are not about to ignore it. Don’t miss this discussion on the economics of combining energy credits with LIHTCs. Learn how developers are adding solar installations to their multifamily apartment portfolios using investment tax credits either through a combination using LIHTCs or via their own captive energy company. Learn how investors view the energy credits, what they will pay for the combined investment, and what issues arise in these transactions.
