Enhanced Use Leasing
The Enhanced Use Leasing (EUL) process is provided under specific authority for a given Federal Agency; for example, the Department of Defense under the Authority of Title 10, U.S.C., Section 2667, as amended. This authority allows for military installations to outlease land and facilities to private or public entities. Specifically, installations can, among other things: 1) outgrant for other types of mission functions; 2) enter into long-term or short-term leases, providing greater flexibility for facility reuse; and 3) receive no less than fair market rental, in cash or in-kind, as consideration for the leased property. Another example is the Department of Veterans Affairs Enhanced Use Lease Legislative Authority Title 38 U.S.C. Sections 8161 through 8169.
