Court Awards $206 Million in Section 1603 Lawsuit

The U.S. Court of Federal Claims last week awarded more than $206 million to cash grant applicants for the Alta Wind project that the U.S. Treasury Department declined to pay under Section 1603 of the American Recovery and Reinvestment Act. The lawsuit alleged that Treasury incorrectly awarded cash grants based largely on the construction costs rather than the purchase price for the 1.55 gigawatt (GW) development in the Mojave Desert. The Department of Justice can appeal the case to the Federal Court.
