House Committee To Resume Mark-Up of Housing Affordability for America Act of 2002

The House Financial Services Committee is expected to resume mark-up of the Housing Affordability for America Act of 2002, H.R. 3995, today at 10 a.m. During a June 20 mark-up, Rep. Barbara Lee (D-Calif.) filed two amendments to the measure, one of which would require local housing agencies (LHAs) to prove that a tenant knew or should have known of the criminal activity of a household member or guest as a prerequisite to evicting a family in both public housing and Section 8 terminations of tenancy. The Supreme Court’s recent decision in HUD v. Rucker supported LHAs’ zero-tolerance policy regarding drug evictions.
