HUD ISSUES GUIDANCE ON PROVIDING DISASTER HOUSING

The U.S. Department of Housing and Urban Development (HUD) today issued guidance to senior housing providers that choose to open vacant units to non-elderly individuals displaced by Hurricane Sandy. The guidance also contains questions and answers about how to exercise this flexibility. According to the notice, as long as the vacant units are made available to evacuees under the age of 55 without restriction on the basis of familial status, the community will remain exempt from the Fair Housing Act’s familial status provision that prevents housing discrimination against families with minor children.
