HUD to Publish Proposed Rule to Implement AFFH; Similar to 2015 Version
The U.S. Department of Housing and Urban Development (HUD) will publish in an upcoming Federal Register a notice of proposed rulemaking to implement the affirmatively furthering fair housing (AFFH) rule, reflecting many of the goals of the initial AFFH rule from 2015. The proposed rule streamlines the required fair housing analysis for communities, states and public housing agencies (PHAs) and requires them to set goals concerning fair housing. The rule incorporates much of the framework of the 2015 AFFH rule which was effective until HUD altered it under the Trump administration. The new proposed rule would require program participants to submit an equity plan to HUD every five years and require participants to incorporate goals and strategies into subsequent planning documents. HUD will seek public comment on the proposed rule for 60 days after its published in the Federal Register.
