HUD Publishes Guidance on Reasonable Accommodation of Service Animals under FHA

The U.S. Department of Housing and Urban Development published guidance Tuesday on assessing a person’s request to have assistance animal as a reasonable accommodation under the Fair Housing Act (FHA). Under the FHA, residents with disabilities may request a reasonable accommodation for service animals or other assistance animals, including support animals. FHEO-2020-02 addresses how to assess a person’s request to have an animal as a reasonable accommodation under the FHA and how to document an individual’s need for assistance animals in housing. The guidance applies to all housing providers covered by the FHA and is effective until amended, superseded or rescinded.
