Judge Rules HUD Must Implement Small Area FMR Rule Jan. 1
The U.S. Department of Housing and Urban Development (HUD) must implement its small-area fair market rent (FMR) rule effective Jan. 1, 2018, after a federal judge issued a preliminary injunction of HUD’s plan to delay the rule for two years. The HUD small area FMR rule was issued in 2016, but HUD delayed the rule’s implementation for two years. The rule affects 24 metropolitan areas and requires public housing authorities to use localized FMRs, rather than region-wide FMRs. A nonprofit organization and two Baltimore, Md., women sued HUD to seek implementation of the rule.
