Texas Group Appeals Decision in Fair Housing Case

Inclusive Communities Project (ICP) today appealed a decision issued by a U.S. District Court last month that dismissed ICP’s disparate impact claim against the Texas Department of Housing and Community Affairs in the allocation of low-income housing tax credits (LIHTCs). The U.S. District Court for the Northern District of Texas ruled Aug. 26 that ICP didn’t prove a prima facie case of disparate impact and dismissed the eight-year-old lawsuit. ICP’s appeal claims that the prima facie case was made and that the court made errors in applying the law. The Supreme Court ruled last summer that disparate impact claims could be made under the Fair Housing Act, but required plaintiffs prove it.
